OFFICE NOTE 01.

05.06.2023 ML,J IA No.1 of 2023 The present application is filed by accused No.8 to relax the conditions imposed in the bail granted by this Court on 12.05.2022 in Crl.P.No.4400 of 2022.

In Crl.P.No.4400 of 2022 the petitioner /A.8 was enlarged on bail by imposing the condition to attend the concerned police station on 1st and 3rd Sunday between 10.00 a.m. and 12 noon till filing of charge sheet.

The learned counsel for the petitioner submits that even after one year also, no charge sheet is filed. The investigation is still in progress, which causes much inconvenience to the petitioner, hence, he seeks to relax the said condition imposed by this Court.

The learned Public Prosecutor submits that large scale scam was involved in this case and therefore, he opposed this petition.

Considering the facts and circumstances of the case, and to balance the interest of both the parties, this Court is inclined to partly relax the said condition.

In the result, the application is partly allowed. The petitioner/A.8 is hereby directed to attend the first Sunday of every month, instead of twice, till charge sheet is filed. ______ ML,J isn
