HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.26245 of 2016 ORDER:

This writ petition is filed for the following relief; "to declare the action of the 3rd respondent in not registering the LMV Maruti Alto 800 LXI BSIV petrol car as per Section 39 of the Motor Vehicles Act 1988, inspite of submission of all valid documents as per Rule 47 of Central Motor Vehicles Rules 1989, issued by the 4th respondent of the new Maruti Cars M/s.Acer Motors, Secunderabad and inspite of producing the car for inspection and inspite of paying the life tad @ 12% of the cost of the vehicle as per the Sixth Schedule of the TSMVT Act, as illegal, arbitrary against the settled law, against the fundamental rights guaranteed under the Constitution of India and against the provisions of Section 39 of MV Act and Rule 47 of CMV Rules 1989 and against the instructions of the 2nd respondent issued in Circular memo No.13/4515/R1/2008, dated 30.08.2008 and to pass such other order or orders as this Hon'ble Court may deems fit just and proper in the circumstances of the case."

Heard learned counsel for the petitioner who submits that the lis in the writ petition is squarely covered by order dated 28.11.2019 passed by this Court in WP.No.26244 of 2019.

The same is not disputed by the learned Assistant Government Pleader for Transport.

In view of the order dt.28.11.2019 passed in WP.No.26244 of 2019 and for the reasons alike, this Writ Petition is also allowed in terms of the said order. Further, the respondents 2 and 3 are directed to take steps to

implement the orders passed by this Court as well as circulars issued by the Department, to avoid unnecessary litigation. No order as to costs. As a sequel thereto, miscellaneous petitions, if any pending, in this writ petition shall stand closed.
