HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 36347 OF 2015 ORDER:

Heard learned counsel for the petitioners and learned Government Pleaders for Revenue. With the consent of both the parties, the Writ Petition is disposed of at the admission stage itself.

The present Writ Petition came to be filed seeking to declare the action of the third respondent in threatening to dispossess the petitioners from their huts in Government land in Survey No.86 of Gajuwaka, Visakhapatnam, while their applications seeking regularization are pending before the second respondent, without prior notice, as illegal and arbitrary. Though various grounds are raised in the Writ Petition, learned counsel for the petitioners restricts his prayer seeking a direction to the second respondent to dispose of the applications made by the petitioners seeking regularization of land in Survey No.86 of Gajuwaka, Vasakhapatnam District vide application Nos.1001-50-23238, dated 15.10.2015, VZG1001-50-24942, dated 19.10.2015 and VZG1001-50-22841, dated 14.10.2015.

Learned Government Pleader for Revenue submits that a time limit may be fixed for disposal of the said applications. Without going into merits of the case and having regard to the circumstances stated above, the present Writ Petition is disposed of directing the second respondent to dispose of the application Nos.1001-50-23238, dated 15.10.2015, VZG1001-50-24942, dated 19.10.2015 and VZG1001-50-22841, dated 14.10.2015, made by the petitioners seeking regularization, within a period of six (06) weeks from the date of receipt of a copy of this order, in accordance with law. Till such time, status quo as on today to be maintained with regard to the possession. No costs.

Consequently, the Miscellaneous Petitions, if any, pending in this Writ Petition shall also stand closed.
