THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.28046 of 2017 ORDER:
The petitioner claims to be the MPTC from Sriharipuram Village of Vijayapuram Mandal, Chittoor District. The grievance of the petitioner in the present writ petition is non-consideration of his representation, dated 05.08.2017, said to have been submitted by him to the respondent authorities, requesting them to shift the six wine shops located at Maruthi township, Maharajapuram Village, Vijayapuram Mandal, Chittoor District. According to the petitioner, the said shops are within 500 meters of the National Highways, State Highways and temples.
Even according to the learned counsel for the petitioner, licences have already been granted. If that being so, the petitioner has an effective alternative remedy of appeal under Section 63 of the A.P. Excise Act (for short, "the Act") and the same can be availed by him. In view of the same, this Court is not inclined to entertain the writ petition.
For the aforesaid reasons, the writ petition is dismissed with liberty to the petitioner to avail the alternative remedy of appeal under Section 63 of the Act against the subject licences. No order as to costs.
