THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.22034 OF 2006 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief: "to issue any Writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the 4 (1) Notification issued by the 1st respondent dated 08-10-2006 in "Vasista Times" a local paper at Eluru only and repeatedly acquiring petitioner's family's land right from 1976 number of times for the same purpose which is a double crop wet land inspite of availability of alternate Government land which is a dry land in a large extent is available in the locality of Tadepalligudem Town known as aerodrome lands and invoking urgency clause under Section 17 of the Land Acquisition Act though there is no such urgency in reality as illegal, arbitrary, capricious unjust and contrary to the central government scheme and policy and violative of Article 14 and 19 of the Constitution of India and consequently to quash the said notification with regard to his land in an extent of Ac.

1.90 cents in R.S.No.18/1 of Yagarlapalli Village Ward No.25, Tadepalligudem Town, West Godavari District." 2.

Learned Government Pleader for Land Acquisition appearing for respondent Nos.1 and 3 stated that the respondents are not intending to proceed with the land acquisition proceedings insofar as the land in question is concerned.

Recording the submission of the learned Government Pleader, this Writ Petition is closed. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
