HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.46023 OF 2016 ORDER:

The petitioner challenges Proceedings Rc.B.449/ 2015 dated 22.05.2015 keeping the petitioner under suspension pending enquiry into the chargers referred therein.

The petitioner on 10.06.2015 filed appeal challenging the order of suspension on several factual and legal grounds. On instructions, learned Government Pleader submits that the appeal is not taken up and as on date the appeal is pending. After perusing the proceedings impugned in the writ petition, this Court is of the view that the appeal filed by petitioner ought to have been expeditiously heard and disposed of, more particularly when the accusation against petitioner is in respect of a small commission or omission. Since the appeal is pending, I am not proposing to examine the merits of the matter. The petitioner is given liberty to submit a copy of this order for disposal of appeal expeditiously within two weeks. The 1st respondent after receiving the representation, fixes a date for hearing, hears the appeal on merits and disposes of the appeal within four weeks thereafter.

The writ petition is disposed of accordingly. No order as to costs.
