Gopadi Madhava Rao v. The State Of Telangana
HON'BLE SMT. JUSTICE JUVVADI SRIDEVI CRIMINAL PETITION No.6987 of 2024 ORDER :
Petitioner/A-1 has filed this petition seeking anticipatory bail in Cr.No.289 of 2024 of P.S. Karimnagar Rural, registered for the offences under Sections 420, 467, 468, 471, 506 and 120-B r/w.34 of IPC.
2.
Heard learned counsel for petitioner and the learned Additional Public Prosecutor appearing for the State.
3.
The allegation against the petitioner is that he registered the land in the name of A-3 by using forged documents. 4.
The grounds for seeking anticipatory bail are that the present case has been registered merely on suspicion, and basing on such crime, the Police are trying to arrest the petitioner and in the event of his arrest, the petitioner will be subjected to great hardship. It is contended that the petitioner is a law-abiding citizen and is ready to co-operate with the Police in investigating the case and that he will comply with the conditions that may be imposed by this Court in the event of his release.
5.
The learned Additional Public Prosecutor opposed the application contending that the investigation in the present case is still
JS, J Crl.P.No.6987 of 2024 pending, and therefore, the petitioner cannot be granted anticipatory bail at this stage.
6.
Having heard both sides and perused the material on record, this Court is of the considered view that the petitioner can be granted anticipatory bail subject to the following conditions:
1. The petitioner/A-1 shall surrender before the Station House Officer of P.S. Karimnagar (Rural) within two weeks from today, and on such surrender, the said Station House Officer shall release the petitioner on bail on his executing a personal bond for Rs.20,000/- with two sureties, each for the like sum.
2. The petitioner shall abide by the other conditions stipulated in Section 438(2) Cr.P.C and co-operate with the Investigating Officer in investigating the case. Petition is allowed accordingly.
