THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.11467 of 2016 ORDER:

This criminal petition is filed to call for records in Crl.M.P.No.2145/2016 in C.C.No.241 of 2013 on the file of the Judicial First Class Magistrate, Mummidivaram, East Godavari District and quash the said proceedings against the petitioner by recalling the NBW dated 16-05-2016.

Heard both sides.

Having regard to the facts and circumstances of the case, I am not inclined to quash the impugned proceedings. However, it is open for the petitioner/accused to surrender before the Court below and file appropriate application within one month from today to recall the warrant. In such an event, the Court below shall dispose of the application of the petitioner on the same day by recalling the warrant pending against the petitioner on condition of the petitioner furnishing a personal bond for Rs.10,000/- with one surety. Till such application is filed, as stated above, the warrant should not be executed. The Criminal Petition is accordingly disposed of. Pending miscellaneous applications, if any, shall stand closed in consequence.
