HONOURABLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION No.6333 OF 2016 ORDER:

The learned counsel for the petitioner would submit that this Court has granted interim stay on 26.4.2016 in Crime No.279 of 2014 of Jawaharnagar P.S., Cyberabad.

The learned Additional Public Prosecutor for the State of Telangana would submit that charge-sheet in this case was filed on 25.4.2016 as the investigation was completed by then. The order passed by this Court on 26.4.2016, granting interim stay, whereas a day prior thereto charge-sheet was filed on completion of investigation by the investigating agency. The order passed by this Court would not be effective so far as filing of charge-sheet is concerned.

The learned Additional Public Prosecutor also would submit that the Court below has even committed the case, perhaps, by assigning P.R.C. number, and as per the information supplied by the learned Additional Public Prosecutor the same has been committed to sessions division vide Sessions Case No.597 of 2016, of course, relevant details are not forthcoming, whether stay order was communicated to the learned Magistrate and other details. Be that as it may, the present petition must become infructuous. The learned counsel, under these circumstances, seeks liberty to file fresh petition challenging the proceedings in Sessions Case in accordance with law. Such liberty is always open to the petitioner.

Thus, the present Criminal Petition has become infructuous and accordingly the same is dismissed as infructuous. As a sequel thereto, Miscellaneous Petitions, if any, pending in the Criminal Petition shall stand closed.
