THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.21818 of 2006 ORDER:
In this Writ Petition, petitioners challenge Circular bearing No.P-19011/9/2001-IOC, dated 16.09.2006 issued by the third respondent - Government of India, rep. by its Secretary, Ministry of Petroleum & Natural Gas, Central Secretariat Buildings, New Delhi.
A perusal of the material on record discloses that the petitioners filed the present Writ Petition on apprehension, without there being any cause of action. In view of the same, it is not necessary for this Court to adjudicate the matter on hypothetical basis.
Learned Standing Counsel for Indian Oil Corporation Limited appearing for respondents 1 and 2 submits that in similar circumstances, a batch of Writ Petitions came to be disposed of by this Court and the Division Bench of this Court upheld the same.
CKR, J W.P.No.21818 of 2006 In those circumstances, this Writ Petition is closed giving liberty to the petitioners to approach appropriate forum seeking appropriate relief as and when cause of action arises. Miscellaneous Petitions, if any pending, shall stand closed. There shall be no order as to costs.
