HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 19109 OF 2016 ORDER:

The writ petition is filed questioning the proceedings dated 25.04.2016, issued by the 2nd respondentRevenue Divisional Officer. It is the case of the petitioner that the respondents have issued the impugned proceedings suspending the authorization of fair price shop solely on the ground that the 6A proceedings have been initiated against the petitioner.

This Court by an order dated 12.11.2010 in W.P.No.227750 of 2010, had categorically held that the proceedings under Section 6A are independent of the enquiry initiated for cancellation of the fair price shop authorization under the clauses of the Control Order. In those circumstances, the suspension pending enquiry cannot be sustained and the same is liable to be set aside. Accordingly, the writ petition is allowed setting aside the proceedings dated 25.04.2016, issued by the 2nd respondent. However, liberty is given to the respondents to complete the enquiry and pass appropriate orders in accordance with law within a period of four weeks from the date of receipt of copy of the order. No order as to costs.
