HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.795 of 2016 ORDER:
This Writ Petition is filed under Article 226 of the Constitution of India, seeking a writ of Mandamus, declaring the action of the first respondent in rejecting the technical bid submitted by the petitioner in pursuance of the eTender, Sealed Tender Notice-cum-Public Auction in Rc.No.G1/5249/2015, dated 07.12.2015 for procurement of provisions for a period of 12 months as illegal and arbitrary. Heard Sri M.Vidyasagar, the learned counsel for the petitioner and Sri A.Srikanth Reddy, the learned standing counsel for the first respondent.
3 At the time of arguments, on instructions, the learned standing counsel submitted that the first respondent has withdrawn the Sealed Tender Notice-cum-Public Auction in Rc.No.G1/5249/2015, dated 07.12.2015. The learned counsel for the petitioner has also consented for the same. In view of the submissions made by the learned counsel for both parties, no further orders need be passed in this Writ Petition.
5 Accordingly this Writ Petition is disposed of. However, the first respondent is at liberty to issue fresh notification in accordance with law, if they so choose. No order as to costs. As a sequel, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
