THE HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No. 18263 of 2012 ORDER:

This writ petition is filed challenging the proceedings in Roc.No.160/2011 dated 20.03.2012 of the 2nd respondent wherein a notice was issued to the petitioner asking her to submit explanation why the building permission granted to her should not be cancelled, as she deviated the approved plan in construction of the building. Heard Sri Y. Subrahmanyam, learned counsel for the petitioner, Smt. K. Manideepika, learned standing counsel for the 1st respondent and Sri Ravi Cheemalapati, learned counsel for the 2nd respondent.

The record reveals that basing on the directions of the 1st respondent as well as the Lokayukta against the complaint of one Muppalla Badari Narayana to take action against the deviations in the constructions made in Penamaluru Village, notices were issued by the 2nd respondent to several villagers apart from the petitioner herein. However, without submitting her explanation to the impugned notice, the petitioner approached this Court by filing the present writ petition. In view of the above, the petitioner is directed to submit her explanation to the show cause notice dated 20.03.2012 within a period of four weeks from today and after submission of the explanation, the respondents may pass appropriate orders, in accordance with law. Till then, the order of status-quo granted on 20.06.2012 shall be maintained.

If the petitioner does not choose to file her explanation to the show cause notice, it is open for the respondents to proceed further, in accordance with law.

With the above direction, the Writ Petition is disposed of. No order as to costs. Consequently, miscellaneous petitions, if any,
