THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.16746 of 2017 ORDER:

Heard both sides. With the consent of both parties the writ petition is disposed of at the admission stage.

The present writ petition came to be filed seeking issuance of writ of Mandamus declaring the action of respondent No.2 in not transferring FIR No.426 of 2016 of Kukatpally (KPHB) Police Station, Hyderabad, to CBCID Women Protection Cell - respondent No.5, though a representation dated 01.04.2017 was made seeking transfer of the said crime, as illegal and arbitrary.

At the time when the matter is taken up for hearing, it is brought to the notice of the Court that the police have investigated the matter and filed charge sheet before the competent Court on 09.12.2016, vide Inward No. 4760/ 2016.

Learned counsel for the petitioner would submit that liberty may be given to her to challenge the proceedings, in case, the said charge sheet is returned for any reason.

Having regard to the above, the writ petition is disposed of giving liberty to the petitioner to challenge the proceedings, in case the charge sheet is returned by the Court. No costs.

As a sequel thereto, Miscellaneous Petitions, if any, pending in this Writ Petition, shall stand closed.
