This Writ Petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the action of the respondents in incorporating Clause of the Eligibility Criteria in the Notice Inviting Tender vide No.4/SGT/2016 (Online Version) for "Purchase of Provisions" regard to Sri Ganesh Temple, Station Road, Secunderabad to the extent of (i) Tenderer should have minimum annual turnover of Rs.10 Crore in Food Grain Business in the Year April 2014 to March 2015 or Rs.10 Crore Turnover in the Year April 2015 to Dec 2015 further specific condition that Rs.10 Crore turnover must in any one of the following Year i.

e, April 2014 to March 2015 or Year April 2015 to December 2015, (ii) the tenderer should have submit the satisfactory supply of food grains experience certificate to Devastanam from Government Institutions in the year 2014-2015, (iii) that the tenderer should have supplied at least a) 2,00,000 Kgs of Rice b) 3,60,000 Kgs of Chana Dal, c) 5000 Kgs of Cashew (two pieces), d)10,000 Kgs of Tamarind, e) 5,00,000/- of Sugar in last financial Year (2014-2015), as being illegal, arbitrary, unconstitutional, discriminatory and set aside the same.

The learned counsel for the petitioners seeks permission of this Court to permit the petitioners to withdraw the writ petition. He also filed a letter in the Registry to that effect. Permission is granted.

Hence, the Writ Petition is dismissed as withdrawn. No costs.

Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
