THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.13509 of 2015 ORDER:

Heard the learned Counsel for the petitioners and the learned Standing Counsel for the Wakf Board.

This Writ Petition was filed challenging the action of the second respondent in incorporating the name of the dead person, Sri Ahmed Ali, who died on 25.11.1986, as Muthawalli in respect of wakf institution known as Dargah Hazrath Syed Shaheed Habeebullah Hussaini published in the gazette dated 03.10.2002.

It is submitted by the learned Counsel for the petitioners that the second petitioner is declared as a defacto Muthawalli and the third respondent is contesting the proceedings pending before the second respondent, wherein an enquiry officer was appointed to conduct a detailed enquiry as to the claims of Towliath.

In view of the pendency of the enquiry proceedings, this Court is not inclined to decide the issues raised in the Writ Petition and it is open to the petitioners to raise all contentions before the enquiry officer appointed by the Chief Executive Officer of the Andhra Pradesh State Wakf Board, Hyderabad, and it is needless to mention that the enquiry would be conducted in accordance with law. The Writ Petition is, accordingly, closed. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs. ________________________________
