THE HONOURABLE SMT JUSTICE JUVVADI SRIDEVI CRIMINAL PETITION No.4409 of 2022 ORDER:

The Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioner/accused seeking to grant anticipatory bail in the event of his arrest in connection with Crime No.149 of 2022 on the file of Korutla Police Station, Jagtial District, registered for the offences under Sections 498-A & 307 IPC and Sections 3 and 4 of the Dowry Prohibition Act, 1961. 2.

Heard the learned counsel appearing for the petitioner, learned Additional Public Prosecutor appearing for the respondent-State and perused the record. 3.

It is alleged in the complaint reported on 22.03.2022, at 11:00 hours, that the petitioner/accused has been harassing the complainant physically and mentally for the last 11 years for additional dowry and on 22.03.2022 at 11:00 hours, the petitioner/accused attempted to commit murder of the complainant by pouring harpic in her mouth forcibly. Hence, the

complainant lodged a complaint on 11.04.2022 at 11:00 hours.

A perusal of the FIR shows that the incident has taken place on 22.03.2022 at 11:00 hours, but the de facto complainant has lodged the complaint on 11.04.2022 at 11:00 hours. Prima facie, there is a delay in lodging of compliant.

Learned counsel for the petitioner/accused submits that the petitioner is ready to abide by any conditions that may be imposed in the event of his enlargement on anticipatory bail.

Learned Additional Public Prosecutor opposed to grant anticipatory bail to the petitioner. 7.

Considering the facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner/accused.

Accordingly, the Criminal Petition is allowed and the petitioner/accused is granted anticipatory bail subject to the following terms and conditions:

(1) The petitioner/accused is directed to surrender before the Station House Officer, Korutla Police Station, Jagtial District, within a period of four (04) weeks from the date of this order and on such surrender, the said Station House Officer shall release the petitioner/accused on his executing personal bond to the tune of Rs.25,000/- (Rupees twenty five thousand only) with two sureties for a like sum each to his satisfaction.

(2) On such release, the petitioner/accused shall personally appear before the investigating authorities on every Sunday of the month between 10.00 A.M. to 2.00 P.M., for a period of two (02) months or till filing of the charge sheet, whichever is earlier.

(3) The petitioner/accused shall abide by the other conditions stipulated under Section (2) Cr.P.C., and shall co-operate with the Investigating Officer in investigating the case.

Miscellaneous applications, if any, pending shall stand closed.
