In this writ petition, it is alleged that respondent No.2 has not initiated any action against respondents 3 to 5 for making unauthorized constructions in the land situated in Survey No.116 and 118 of Shanthi Nagar, Waddepalli Municpality on Kurnool-Raichur Main Road; and therefore prays the Court to direct respondent No.2 to take action for stopping the construction being made by respondents 3 to 5.

Learned Standing Counsel appearing for 2nd respondent-Municipality, on instructions, would submit that respondents 3 to 5 have not obtained permission and, therefore, a provisional notice has been issued on 06.08.2019. 3.

In those circumstances, as action had been initiated by the authorities by issuing notice, the writ petition is disposed of with a direction to the respondent authorities to complete the enquiry and take necessary action, in accordance with law; and admittedly as no permission was granted to respondents 3 to 5, it shall be the responsibility of the respondent authorities to ensure that the construction alleged shall not be allowed to be undertaken.
