THE HON'BLE SMT.JUSTICE G.ANUPAMA CHAKRAVARTHY CRIMINAL PETITION NO.4411 OF 2022 ORDER:

This Criminal Petition is filed under Section 167(2) of Code of Criminal Procedure (Cr.P.C.) to enlarge the petitioner Korra Sahadev on statutory bail as charge-sheet has not been filed within the stipulated period of 180 days.

Petition in Crl.M.P.No.680 of 2022 is moved before the trial Court for statutory bail and the same was dismissed on 10.05.2022 on the ground that the seized contraband is of commercial quantity and investigation is still pending and therefore, the trial Court has refused to grant bail to the petitioner.

Heard learned counsel for the petitioner and learned Public Prosecutor. Perused the record.

Admittedly, the petitioner was remanded to judicial custody on 30.10.2021 and he is languishing in jail for more than 180 days and as on today charge-sheet was not filed in this crime i.e. Crime No.311 of 2011 on the file of the P.S., Chityal.

In the above stated facts and circumstances, the petitioner is entitled for statutory bail under Section 167(2) of Cr.P.C., as prayed for.

In the result, this petition is allowed and the petitioner / Korra Sahadev is ordered to be enlarged on statutory bail in connection with Crime No.311 of 2011 on the file of the P.S., Chityal, on condition that he shall execute a personal bond for Rs.50,000/- (Rupees fifty thousand only) with two sureties for like sum each to the satisfaction of the I Additional Sessions Judge, Nalgonda. Further, the petitioner shall appear before the concerned SHO on every Sunday between 10.00 A.M. and 12.00 noon till the date of filing of charge-sheet and he shall not involve in any other similar offences and shall not leave the jurisdiction of Nalgonda without prior permission of the Court till the date of filing of charge-sheet.

As a sequel, interlocutory applications, if any pending in this petition, shall stand closed.
