THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CIVIL REVISION PETITION No.4110 OF 2017 ORDER:

This Civil Revision Petition is filed under Section 115 of C.P.C. challenging the order dated 04.07.2017 passed in E.A.No.58 of 2017 in E.P.No.6 of 2015 in O.S.No.27 of 2014 on the file of the Court of the Senior Civil Judge at Bobbili.

At the time of arguments, learned counsel for the petitioner submitted that during pendency of the revision petition, the petitioner/judgment debtor deposited the amount in E.P.No.6 of 2015. He further submitted that the petitioner has no objection for withdrawing of the deposited amount by the respondent/decree holder.

In view of the submission made by the learned counsel for the petitioner, the purpose of filing the revision petition has become infructuous.

Hence, the Civil Revision Petition is dismissed as infructuous. However, dismissal of this revision petition does not preclude the respondent to withdraw the amount deposited in E.P.No.6 of 2015. There shall be no order as to costs. 5.
