THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No. 17486 OF 2019 O R D E R :

This writ petition is filed challenging the action of the respondents 2 to 5 in trying to evict the petitioners from their shops No.3 and 1, Door No.15-1/3, situated at TNGO's Complex, NSP Compound, Miryalaguda Town, Nalgonda District, at the instance of respondent No.6. Learned Assistant Government Pleader for Home produced written instructions dt.21.08.2019 submitted by the Sub-Inspector of Police, Miryalaguda II Town P.S., Nalgonda District. To the extent of their relevance to the present writ petition, the said instructions read as under:

" It is submitted that basing one M.Sravan Kumar, President of Telangana Non Gazetted Officer's Association, NSP Unit, Miryalaguda, gave a complaint to the Sub-Divisional Police Officer, Miryalaguda on 01.08.2019 with a request to vacate the tenants from the Union shops who forcefully saying and lease was completed 3 years ago i.e., 30.06.2016 and such requested to kindly arrange to handover the shops to the TNGOs Union, Miryalaguda.

It is submitted that the same was forwarded to the Station House Officer, Miryalaguda II Town through proper channel, wherein the Station House Officer on receipt of above complaint, GD entry was made and enquiry was done, during enquiry called both the parties to police station and on verification of documents it came to know that the matter is pertaining to lease issue, as such informed both the parties to approach the

concerned court as the matter is civil in nature. That the petitioner given by President of Telangana Non Gazetted Officer's Association, NSP Unit, Miryalaguda, was closed as civil in nature."

In view of the aforesaid written instructions, recording the same, the writ petition is disposed of directing the respondents 1 to 5 not to interfere with the possession of the petitioners over the subject property. However, it is open for the 6th respondent to workout his remedies, in accordance with law only. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
