HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.17210 OF 2019 ORDER:

This writ petition is filed with the following prayer: " to issue an order or direction more particularly one in the nature of writ of Mandamus declaring the action of the respondents No.2 to 4 in not providing the police aid to the agriculture property of the petitioner over the land admeasuring Ac.3-00 guntas in Sy.No.22, situated at Jampally village, Bibinagar Mandal, Yadadri Bhongir District (Erstwhile Nalgonda District), duly considering the representations dated 05-12-2018 and 17-06-2019 submitted by the petitioner for implementing the injunction order, dated 31-12-2014 passed in I.A.No.705 of 2014 in O.S.No.

105 of 2014 on the file of Principal Junior Civil Judge at Bhongir, is nothing but illegal, arbitrary and violative of Articles 14, 19, 21 and 300-A of the Constitution of India apart from being violative of principles of natural justice and consequently direct the respondent authorities to provide police aid to the agricultural property in Sy.No.22 admeasuring Ac.3-00 guntas, situated at Jampally and to act upon the complaints, dated 05-12-2018 and 17-062019 submitted by the petitioner and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

Learned counsel for the petitioner submits that injunction order granted in I.A.No.705 of 2014 in O.S.No.105 of 2014, dated 31-12-2014 has not been extended beyond 30-01-2017. If that is the case, the question of granting police aid for implementation of said order which is non-existent does not arise. When the same is pointed out, learned counsel seeks permission to withdraw the writ petition with liberty to approach this Court as and when said injunction order is extended.

In view of the same, the writ petition is dismissed as withdrawn. It is open for the petitioner to approach the concerned Court or this Court for providing police aid for implementation of injunction order as and when it is extended.
