HON'BLE SRI JUSTICE A. SHANKAR NARAYANA C.C.C.A.No.102 of 1999 JUDGMENT :
A decree was passed on 16.04.1999, in a regular suit in O.S.No.1598 of 1997 by the I Senior Civil Judge, City Civil Court, Hyderabad, filed by Vijay Bhargavi Chit Fund Private Limited, Hyderabad, which is the 1st respondent in the appeal, directing the defendants therein jointly and severally to pay to the plaintiff a sum of Rs.1,73,761/- with interest at 12% per annum from the date of the suit till realization on Rs.1,53,124/- and also granting instalments @ Rs.5,000/- each, payable on or before 10th of every succeeding month, to clear the decretal amount, the 1st instalment of which should commence from June, 1999, with a default clause, giving liberty to the plaintiff to recover the balance amount in lumpsum. Aggrieved by the said judgment and decree dated 16.04.1999, the 3rd defendant in the suit filed the instant appeal.
2. When the matter was listed for hearing on 27.07.2016, there was no representation on either side. Therefore, the Registry was directed to list the matter under the caption "FOR DISMISSAL".
3. Even today, despite the matter being listed under the caption "FOR DISMISSAL", there is no representation for the appellant, though learned counsel for the 1st respondent - Vijay Bhargavi Chit Fund Private Limited represented the matter. It appears that the appellant is not interested in pursuing the matter.
4. Accordingly, the appeal is dismissed for non-prosecution. As a sequel, miscellaneous petitions pending, if any, shall stand
closed. No order as to costs.
