THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE M. SEETHARAMA MURTI CONTEMPT CASE No.2065 of 2016 ORDER: (per Hon'ble Sri Justice Sanjay Kumar) This contempt case was instituted alleging willful disobedience to the order dated 22.07.2016 passed by this Court in W.P.No.23427 of 2016.
By the said order, this Court limited the entitlement of the first respondent to interest on the delayed payment of his pensionary benefits from 1st February, 2013, up to the date of actual payment in November, 2013. The complaint was that this interest amount had not been remitted.
However, the Joint Director, Scheduled Caste Development Department, Ranga Reddy District, filed a counter-affidavit duly supported by the evidence of payment having been made. The letter dated 16.09.2016 addressed by the Joint Collector, Scheduled Caste Development Department, Ranga Reddy District, to the petitioner demonstrates that demand draft bearing No.946860 dated 09.09.2016 drawn on State Bank of Hyderabad, Vikarabad, in the name of the petitioner for a sum of Rs.49,347/- was enclosed with the said letter towards payment of the interest in terms of the order passed by this Court.
We find no reason to exercise contempt jurisdiction given the aforestated developments. In the event the petitioner has any grievance with the quantification of the interest amount, it would give rise to a fresh cause of action and he would necessarily have to seek redressal thereof by way of independent proceedings as the same cannot be examined in contempt proceedings.
Subject to the above observation, the contempt case is closed. No order as to costs.
