THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.5186 of 2007 ORDER:

Petitioner was appointed as Clerk on 01.10.1988 in Sri Laxminarayana Swamy Temple, Nagunuru Village of Karimnagar Mandal and District. His appointment was ratified by the fourth respondent by proceedings, dated 24.06.1989. On 31.08.2001, he was appointed as Person-in-Management along with others and posted to Sri Sitaramachandraswamy Temple, Illantakunta Village, Jammikunta Mandal, Karimnagar District. He was placed under suspension by proceedings, dated 26.07.2005 on the ground that he was arrested by the police for playing cards. Crime No.144 of 2005 was registered against him. An enquiry officer was also appointed to conduct enquiry into the matter. Six charges were framed against the petitioner and charges 3 to 5 were held proved. In pursuance of the report of the enquiry officer, punishment of stoppage of one increment without cumulative effect was imposed on the petitioner and he was ordered to be reinstated into service by proceedings, dated 28.11.2006. However, the respondents reopened the matter by issuing orders of reinstatement on 13.02.2007 and repatriating

ARLR, J W.P.No.5186 of 2007 him to a parent temple, Sri Laxminarayana Swamy Temple, Nagunuru Village. Challenging the same, he filed the present Writ Petition.

This Court by order, dated 15.03.2007 suspended the said order and directed the respondents to continue the petitioner as Person-in-Management of Sri Sitaramachandraswamy Temple, Illantakunta Village, Jammikunta Mandal, Karimnagar District until further orders.

No counter-affidavit was filed and the said order was made absolute by order, dated 16.06.2010.

Till today, no counter-affidavit is filed. In view of the same, the order, dated 16.06.2010 passed by this Court is recorded as a final order in the Writ Petition. However, liberty is given to the respondents to pass appropriate orders in accordance with law in future, if they so choose.

The Writ Petition is accordingly allowed.
