Complainant Petition under Section 438 of Cr.PC., praying that in the circumstances stated in the memo of grounds filed herein, the High Court may be pleased to grant Anticipatory bail to the Petitioner/Accused in the event of his arrest in connection with in Crime No. 619 of 2015 on the file of Vigilance & APTS P.S., Rajahmundry, in the interest of justice. The petition coming on for hearing, upon perusing the Petition and the grounds filed herein, and upon hearing the arguments of Sri G Rama Gopal, Advocate for the Petitioner, and of Public Prosecutor (AP) for Respondent, the Court made the following ORDER:
This Criminal petition under Section 438 of the Code of Criminal Procedure is filed by the petitioner/accused seeking grant of anticipatory bail in crime No. 619 of 2015 on the file of the Vigilance and APTS Police Station, Rajahmundry, registered for the offence under Section 135 of the Electricity Act. Heard and perused the records.
The allegation against the petitioner herein is that he has indulged in the theft of energy dishonestly for other purposes, than the purpose for which he has obtained the service connection.
Learned counsel for the petitioner submits that the Electricity Department assessed the loss sustained by the Department is to the extent of Rs. 9,96,466/- and directed to pay Rs. 1,50,000/- for compounding the offence. He further submits that the petitioner has not committed any offence and he is a law abiding citizen
and is ready to cooperate with the investigating agency. Hence, he prays this Court to grant anticipatory bail to the petitioner herein.
Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner/accused.
The petitioner/accused is directed to surrender before the Vigilance & APTS P.S. Rajahmundry concerned on or before 0701-2016 and on such surrender, he shall be enlarged on bail on the same day on his executing a personal bond for a sum of Rs. 10,000/- (Rupees ten thousand only) with one surety for the like sum to the satisfaction of the Vigilance & APTS P.S, Rajahmundry. Further, the petitioner/accused is directed to appear before the Station House Officer as and when required. The Criminal Petition is accordingly allowed Sd/- D.
