2016-07-27M.S.Ramachandra Rao2 pages

THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.24387 of 2016 ORDER:

Heard Smt.N.Anula, learned counsel for petitioner and the learned Government Pleader for Home appearing for respondent Nos.1 to 3.

2.

Petitioner's grievance is that at the instance of 4th respondent, the 3rd respondent is interfering in the civil dispute between the petitioner and 4th respondent. 3.

Learned counsel for petitioner has relied upon an order dt.17-06-2016 passed in I.A.No.607 of in O.S.No.396 of 2016 by the II Additional Junior Civil Judge, Ranga Reddy District at L.B. Nagar issued in petitioner's favour restraining the 4th respondent from interfering with the peaceful possession and enjoyment of petitioner over the subject land. 4.

This order indicates that such injunction was granted till 24-06-2016.

5.

Learned counsel for petitioner states that the injunction order was later extended and is subsisting as on today.

6. Since the matter is seized by the Civil Court, it is not open to respondent Nos.1 to 3 to interfere in the civil dispute between the petitioner and 4th respondent, unless directed by the Civil Court, since the 4th respondent can as well participate in the suit and contest it. 7.

Therefore the Writ Petition is disposed of directing respondent Nos.1 to 3 not to interfere in the civil dispute between the petitioner and 4th respondent. No costs.

8. As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
