It is the case of the petitioner that the respondents issued proceedings dated 16-12-2000 imposing punishment on the petitioner for stoppage of next annual grade increment with cumulative effect and the petitioner filed the appeal against the same and the same was rejected in the year 2002. After a period of fifteen years, the petitioner filed mercy petition on 07-07-2017 and it was also rejected on 15-07-2017. Aggrieved by the same, the present writ petition is filed.
Learned Assistant Government Pleader for Services says that there is no whisper about delay in filing the writ petition and as such, the writ petition is liable to be dismissed for latches. Learned counsel for the petitioner says that similarly situated persons were granted relief. In this case admittedly, punishment was imposed on 16-12-2000 and the appeal was rejected on 06-08-2002 and mercy petition is stated to have been filed in the year 2017 and the same was rejected. There is no whisper in the affidavit as to why the writ petition was filed after long lapse of time. In view of the same, the writ petition is liable to be dismissed on the ground of latches.
Accordingly, the writ petition is dismissed. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
