THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.39941 of 2015 ORDER:

The prayer of the petitioner in this case is as under: "For the reasons stated in the accompanying affidavit, the petitioner prays that the Hon'ble Court may be pleased to issue a Writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 3rd respondent, in calling the petitioner to the 3rd respondent Police Station by interfering into civil disputes is illegal, arbitrary, in violation of principles of natural justice and in violation of Articles 14, 19 (1)(g) and 21 of the Constitution of India and consequently direct the respondent No.

3 not to interfere with the petitioner's day to day life by calling the petitioner to 3rd respondent Police Station by forcing to sit in the station hours together, and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case." The Inspector of Police, Anandapuram Police Station, Vishakapatnam City, filed a counter-affidavit denying the allegation of the petitioner that he was being called to the police station for the purpose of interfering into his civil disputes. He stated that the petitioner was involved in three crimes which are pending investigation and a rowdy sheet had also been opened in his name and was being maintained on the file of the Anandapuram Police Station since 16.02.2015.

He further stated that the petitioner was called to the police station only to get his details and that the police authorities never forced him to sit for hours together in the police station.

In the light of the afore-stated unrebutted counter-affidavit averments, the petitioner can have no grievance with regard to any interference with his life and liberty by the police authorities in the context of the pending criminal investigation or the rowdy sheet opened in his name.

The writ petition is accordingly closed.

Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
