HON'BLE SRI JUSTICE Dr. B. SIVA SANKARA RAO CRIMINAL PETITION No.4927 of 2018 ORDER:

The petitioner/ accused filed this Criminal Petition under Section 438 Cr.P.C., seeking release in the event of his arrest in connection with Crime No.593 of 2017 of Patamata Police Station, Vijayawada, Krishna District, registered for the offence punishable under Sections 420 I.P.C.

Though the anticipatory bail application is filed on 24.04.2018, from the very submission of the learned Public Prosecutor, the petitioner was produced on P.T.Warrant having been in judicial custody in other crimes pending against him of the same police station, thereby, the application for anticipatory bail is not maintainable, but for, regular bail. 3.

Accordingly, the Criminal Petition is dismissed, without prejudice to avail such remedy to decide on own merits. 4.

Consequently, miscellaneous petitions, if any shall stand closed.
