HONOURABLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.21837 OF 2009 ORDER:
This writ petition is filed seeking a direction to the respondents to re-fix the pay of the petitioner on par with V. Laxmaiah, working as Conductor with effect from 1.4.2005 and pay arrears to the petitioner.
Heard Sri P. Govinda Rajulu, learned counsel for the petitioner and Sri B. Mayur Reddy, learned Standing Counsel for the respondent.
It has been contended by the learned counsel for the petitioner that the petitioner was appointed as a Conductor on 1.1.1992 and he has submitted a representation on 28.5.2007 to re-fix his pay on par with one V. Laxmaiah, but the respondents have not considered the said representation. In those set of circumstances, the petitioner has submitted another representation on 15.2.2009. Even this representation is pending before the respondents and interest of justice would be met, if the said representations which are pending before the respondents are directed to be disposed within a reasonable period of time. Learned Standing Counsel appearing for the respondents, had contended that the petitioner is not entitled for re-fixation of his pay on par with V. Laxmaiah and there are no merits in the writ petition.
Having considered the rival submissions made by the parties, this Court is of the considered view that this writ petition can be disposed of directing the respondents to dispose of the representations submitted by the petitioner on 28.5.2007 and
15.2.2009, and pass appropriate orders, in accordance with law, as early as possible preferably within a period of four weeks from the date of receipt of copy of this order.
With these observations, the writ petition is disposed of. No order as to costs.
Miscellaneous Petitions, if any pending in this writ petition shall also stand closed.
