HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.32203 OF 2011 ORDER:

This writ petition is filed challenging the action of the respondents in not initiating the action on the resolution dated 23.09.2011 of the Fishermen Cooperative Society Limited, Lolla Village, under Section 16(2) of the APCS Act, 1964, for amendment of Bye- Law No.1 of the Bye-laws. Heard both sides.

When the matter is taken up for hearing, the learned Government for Fisheries (A.P), placed on record the proceedings dated 13.11.2015, issued by the 3rd respondent-Assistant Director of Fisheries stating that there are no disputes in the Society matters and the Society is functioning under the Presidentship of Sri Vatala Srinivasa Rao and the Managing Committee, as on date. Having regard to the facts and circumstances of the case and especially in view of the proceedings dated 13.11.2015, issued by the 3rd respondent-Assistant Director of Fisheries, the relief which was sought in the present writ petition virtually stands granted. In that view of the matter, nothing survives in the writ petition. Accordingly, the writ petition is dismissed as infructuous. No order as to costs. Miscellaneous Petitions, if any pending in this writ petition shall stand closed. No order as to costs.
