HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN WRIT PETITON No.24079 of 2011 ORDER:

The relief sought for, in this Writ Petition, is for a mandamus to declare the action of the Kakatiya University in not extending affiliation to the petitioner college, for the academic year 2011-2012, to offer B.Ed. Course with an intake of 100 students, as arbitrary, illegal and contrary to the orders passed in W.P. No.22178 of 2018 dated 28.08.2009, and in violation of Articles 14 and 19(1)(g) of the Constitution of India.

W.P. No.22178 of 2008, filed by another educational institution against the Kakatiya University, was disposed of granting liberty to the petitioner therein to prefer a statutory appeal against the order of withdrawal of recognition, if not already filed, within a period of four weeks; and the appellate authority was directed to receive the said appeal, treating it as an appeal filed within limitation, and dispose it of in accordance with law after hearing both the parties. Till such time, status quo, obtaining as on the date of the order, was directed to be maintained in all respects.

In the present Writ Petition, i.e W.P. No.24079 of 2009, the petitioner sought an interim direction to the Kakatiya University to extend affiliation to the petitioner college for the academic year 20112012 to offer B.Ed course with an intake of 100 students. In its order, in WPMP No.29521 of 2011, this Court took note of the submission, made on behalf of the Kakatiya University by its Standing Counsel, that, in the light of the orders passed in W.P. No.22178 of 2008 dated 28.08.2009, the recognition granted in favour of the petitioner has

remained in force. Consequently the Learned Single Judge granted interim direction as prayed for to the respondents which, as noted hereinabove, is to direct the Kakatiya University to extend affiliation for the academic year 2011-2012. As the petitioner must have been granted affiliation for the academic year 2011-2012 pursuant to the interim order passed by this Court, and as the academic year 20112012 expired nearly six years ago, it is evident that the cause in the Writ Petition does not survive necessitating any further adjudication by this Court.

The Writ Petition is accordingly closed. The miscellaneous petitions pending, if any, shall also stand closed. No costs. _______________________________ RAMESH RANGANATHAN, ACJ Date: 20.04.2018 MRKR
