THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.1952 OF 2016 ORDER:
This petition is filed by the petitioners-accused Nos.1, 2 and 4 seeking to quash the proceedings against them in C.C.No.6 of 2016 on the file of the X Metropolitan Magistrate at Malkajgiri, Cyberabad.
Heard.
It is alleged that the petitioners and other accused induced the 2nd respondent-complainant to lend the amount to them and later, A1 issued a cheque and the same was dishonoured and when the 2nd respondent demanded the accused for repayment of the amount, they executed sale deeds in respect of flats being constructed by them and when the 2nd respondent started attending the works at flats, A1 along with his henchmen demolished the works and fixtures and threatened the complainant. Thus, the petitioners and other accused committed the offence punishable under Sections 420, 468, 447 and 506 r/w 120-B IPC and Section 323 r/w 34 IPC.
Considering the facts and circumstances of the case, this Court is not inclined to interfere with the proceedings in the above C.C.
At this stage, the learned Counsel for the petitioners prayed for dispensing with the presence of the petitioners before the Court below.
In view of the request made by the learned Counsel for the petitioners, the presence of the petitioners before the Court below is dispensed with, except on the dates when their presence is insisted by the Court below. The petitioners shall be represented
before the Court below by a Counsel on all hearing dates. With the above direction, the Criminal Petition is disposed of. Consequently, the Miscellaneous Petitions pending, if any, shall stand closed.
