THE HONOURABLE SRI JUSTICE K.LAKSHMAN CRIMINAL PETITION NoS.4422 & 4436 of 2022 COMMON ORDER:

These applications are filed by the petitioners/A.3 & A.5 for grant of regular bails. The petitioners herein are Accused Nos.3 and 5 respectively in Crime No.162 of 2022 of P.S. Bowenpally. The offences alleged against the petitioners are under Sections 27, 8 (c) read with 20(b)(ii)(B) of Narcotics Drugs Psychotropic Substances Act (for short 'the NDPS Act').

Heard learned counsel for the petitioners in both the criminal petitions and learned Assistant Public Prosecutor. Perused the record.

The allegations against the petitioners are that on 07.04.2022 the Police, Bowenpally Police Station seized a plastic bottle containing 315 grams of Hash Oil from the possession of the petitioners herein and other accused. The said quantity is less than the commercial quantity. Petitioners were arrested on the same day.

Learned Assistant Public Prosecutor, on instructions would submit that the Investigating Officer has recorded the statements of eight witnesses and the investigation is almost completed. 5.

Considering the said fact more particularly the quantity is less than the commercial quantity and that the petitioners are in jail from 07.04.2022, the Court is inclined to grant bail to the petitioners herein.

Accordingly, the Criminal Applications are allowed subject to the following conditions :

(i) The petitioners/A.3 & A.5 shall execute personal bonds for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties for the like sum each to the satisfaction of I-Additional Metropolitan Sessions Judge, Hyderabad.

(ii) The petitioners/A.3 & A.5 shall appear before the Station House Officer, P.S. Bowenpally on every Sunday between 10.00 AM and 5.00 PM, till completion of investigation and filing of charge sheet. They shall also abide by the conditions stipulated under Section 437 Cr.P.C.

(iii) The petitioners shall cooperate with the Investigating Officer.

In the event of petitioners involving in any other crime other than this crime, liberty is granted to the police to take action in accordance with law. Miscellaneous petitions pending, if any, shall stand disposed of.
