This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioner/ A.3, for grant of anticipatory bail in Crime No.191 of 2019 of Bowenpalli Police Station, Hyderabad, registered for the offences punishable under Sections 406, 420, 421, 422, 423, 424, 120B read with 34 of IPC and Sections 3, 4 and 5 of PC & MCSBA, 66D ITA Act, 2008 and Section 5 of T.P. of Depositors of Financial Establishment Act, 1999.

Heard learned counsel for the petitioner/ A.3, learned Additional Public Prosecutor representing the respondent/ State and perused the record.

Learned counsel for the petitioner/ A.3 would submit that the de facto complainant invested money with A.1 and not with the petitioner. There are no allegations against the petitioner to attract the offences under Sections 406 and 420 of IPC and other penal offences. The petitioner is falsely implicated in the aforesaid crime. The petitioner neither cheated nor received any amount from the de facto complainant or any other individual. The petitioner is ready to abide by the conditions imposed by the Court.

Learned Additional Public Prosecutor representing the respondent-State opposed to grant bail to the petitioner/ A.3. 5.

As seen from the contents of the FIR, there are specific allegations that the accused used to collect money from different persons in the name of Conx trading USA Company and cheated them.

The petitioner and other accused are looking after the said business. Hence, this Court is not inclined to grant anticipatory bail to the petitioner/ A.3.

Accordingly, the Criminal Petition is dismissed. However, if the petitioner/ A.3 surrenders before the Court below concerned and move an application for regular bail, after giving prior notice to the Public Prosecutor concerned, the same may be considered on the same day in accordance with law.
