Heard learned counsel for the petitioners/A.1 to A.3 and learned Additional Public Prosecutor for the respondent State, and perused the record.
This petition is filed under Section 439 Cr.P.C. for grant of bail to the petitioners/A.1 to A.3 in Crime No.23 of 2017 of Tuni Police Station, East Godavari District, for the offence punishable under Section 8(c) read with 20(b)(ii)(c) of NDPS Act.
As per the prosecution case, 50 kgs of ganja was seized from the possession of the petitioners/A.1 to A.3 on 28.02.2017 at about 2.30 p.m. under a cover of panchanama. The petitioners belong to a different State. The allegations are grave. There is possibility of the petitioners evading the trial. It is not a fit case to grant bail to the petitioners/A.1 to A.3. However, under these circumstances, the Court below can be directed to expedite the trial.
In the result, this Criminal Petition is dismissed. The Court below is directed to complete the trial and pronounce the judgment in NDPS S.C.No.142 of 2017 within six months from the date of receipt of a copy of this order.
