HONOURABLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.25027 OF 2002 ORDER:

This writ petition is filed seeking to issue a writ of Mandamus declaring the action of the respondent in deducting an amount of Rs.2,100/- from the salary of the petitioner by way of penal rent for the house bearing No.6-3-76/1 at power House colony, Godavarikhani, as illegal and arbitrary. 2.

Heard Sri P. Udaya Bhaskara Rao, learned Counsel for the petitioner and Sri J. Srinivas Rao, learned Standing Counsel for the respondent.

It has been contended by the petitioner that he was allotted quarter bearing No.6-3-76/1 at power House colony, Godavarikhani and the respondent is erroneously charging penal rent at the rate of Rs.2,100/- and the said amount is being deducted from the salary of the petitioner and that the penal rent should not be levied on the petitioner. 4.

Learned Standing Counsel for the respondent contended that the respondent has rightly calculated the penal rent and is rightly deducting the same from the salary of the petitioner. 5.

Having considered the rival submissions made by the parties, this Court is of the view that when the petitioner

occupied the quarter, he is liable to pay rent and if he is in occupation of any premises illegally beyond his tenure, he is liable to pay penal rent. There are no merits in this writ petition. 6.

Accordingly, the Writ Petition is dismissed. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
