THE HONOURABLE SRI JUSTICE N.TUKARAMJI CRIMINAL PETITION NO. 4427 OF 2022 O R D E R:

This Criminal Petition is filed under Sections 437 and 439 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C.") seeking to enlarge the petitioner/Accused on bail in Crime No.162 of 2022 on the file of XXII Additional Metropolitan Magistrate, Medchal, Ranga Reddy District, registered for the offences punishable under Sections 417 and 376 of Indian Penal Code.

The petitioner is the sole accused. The accusation is that he enticed the complainant/victim in the name of love and marriage, physically exploited her and later refused to marry. 3.

Learned counsel for the petitioner/accused submits that the petitioner and the victim are majors and they had love affair, however, as the matter is not fructified, the complainant foisted the false case and he never committed any offence. Further, the petitioner is in judicial custody since 25.02.2022 and so far, no charge sheet is filed. Hence, prayed for grant of bail.

Learned Assistant Public Prosecutor opposed the bail application and submits that the investigation is pending for recording the statement of the victim under Section 164 of Cr.P.C. 5.

I have perused the record. Having regard to the facts and circumstances of the case, duration of judicial custody undergone of the petitioner/accused and the stage of the investigation, I am inclined to grant bail to the petitioner/accused on the following conditions.

1) The petitioner/accused is directed to be released on bail on his executing a self bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties for a like sum each to the satisfaction of XXII Additional Metropolitan Magistrate, Medchal, Cyberabad Commissionerate.

2) The petitioner/ Accused shall furnish his address and contact particulars and the changes, if any, from time to time to the Investigating Officer, till final disposal of the case. 3) The petitioner/accused shall be available for interrogation as and when required by the investigating agency till filing of the final report.

4) The petitioner/accused shall not cause or intimidate the prosecution witnesses or shall in anyway tamper with the evidence of the prosecution case.

With the above directions, the Criminal Petition is allowed. As a sequel thereto, miscellaneous petitions, if any pending, shall stand closed.
