Learned counsel for petitioner-Accused submitted that in the present case, charge sheet is already filed and the present application has become infructuous. However, seeks permission of this Court to withdraw the Criminal Petition and to file quash petition quashing the charge sheet. 2.

Permission is accorded.

Accordingly, the Criminal Petition is dismissed as withdrawn. However, the petitioner-Accused is at liberty to move this Court seeking quashment of the proceedings of the charge sheet.

Miscellaneous applications pending, if any, shall stand closed.
