THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.15162 OF 2018 ORDER:

Heard learned counsel for the petitioner and Sri L.Prabhakar Reddy, learned Standing Counsel for Telangana State Industrial Infrastructure Corporation Limited (TSIIC).

Against a notice issued under Sections 452(1) and 461(1) of Hyderabad Municipal Corporation Act, 1955, the present writ petition is filed.

A reading of the said notice clearly discloses that it is a show cause notice asking the petitioner herein to show cause as to why deviated portion/unauthorised construction shall not be removed, altered or pull down.

On instructions, it is submitted by the learned Standing Counsel for the TSIIC that it is for the petitioner to submit an application to the said show cause notice and further action will be taken in accordance with law.

In view of the above submission, the Writ Petition is disposed of keeping it open to the petitioner to submit an explanation within a period of two weeks from the date of receipt of a copy of this order. If any such explanation is filed within the time stipulated, the respondents are directed to consider the same and pass appropriate orders in accordance with law, within a period of six weeks thereafter. There shall be no order as to costs. Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
