THE HON'BLE SRI JUSTICE SANJAY KUMAR AND THE HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO WRIT APPEAL No.719 of 2008 JUDGMENT: (per Hon'ble Sri Justice Sanjay Kumar) The Andhra Pradesh State Road Transport Corporation (APSRTC) filed this appeal aggrieved by the order dated 30.08.2004 passed by a learned Judge disposing of W.P.No.20757 of 2002 with certain directions. As per the said order, in the event the APSRTC had granted the benefit of seniority and regularisation to any Conductors junior to the petitioner in the relevant seniority list of the concerned division/region or if such Conductors were held entitled to get such benefit by virtue of any judgment which had become final, then the APSRTC was directed to give the same benefit to the petitioner who was senior to them on the same principle.

Sri P. Durga Prasad, learned Standing Counsel for the APSRTC, states on the basis of the written instructions furnished by the Personnel Officer, APSRTC, Prakasam Region, that no junior to the petitioner had been granted the benefit of regularisation from an earlier date, whereby the petitioner could seek similar relief on the basis of the order under appeal. That being so, on obtaining facts, the direction given by the learned single Judge does not cause any adversity to the APSRTC and therefore, the cause in this appeal does not survive for consideration on merits.

The writ appeal is accordingly dismissed.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
