HON'BLE DR. JUSTICE B. SIVA SANKARA RAO Crl.P.M.P.No.3054 of 2017 IN/AND Crl.P.No.3090 of 2017 ORDER:

The petitioners/accused Nos.1 and and the 2nd respondent-defacto complainant, of S.C. No.33 of 2011 on the file of Assistant Sessions Court, Nirmal without reference to the pending Crl.A. No.86 of 2014 of I Additional Sessions Juge, Adilabda, which are outcome of P.R.C. No.33 of 2009 in Crime No.17 of 2009 of P.S. Kubeer, registered for the offences punishable under Sections 147, 148, 452, 323, 324, 326, 307 r/w 149 IPC, are present before this Court and stated that they settled the matter amicably outside the Court and the terms of the compromise was also appended.

Learned public prosecutor representing the 1st respondentState opposed for compounding the offences particularly for Section 307 IPC concerned. However, the injured persons themselves came and filed their affidavits stating that they are all willing to compound.

Having regard to the above and in view of compromise of the parties, the offences are compounded and the Accused Nos.1 and 4 are acquitted and the bail bonds of the accused Nos.1 and 4, if any, shall stand cancelled.

Accordingly and in the result, both Crl.P.M.P.No.3054 of 2017 and the Criminal Petition are allowed. Pending miscellaneous petitions, if any, shall stand closed.
