THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL REVISION CASE No.1301 of 2013 ORDER:

This Criminal Revision Case is filed under Sections 397 and 401 of Cr.P.C. challenging the orders dated 06.05.2013 passed in Crl.M.P.No.4537 of 2012 in C.C.No.328 of 2011 on the file of the Court of the II Additional Judicial Magistrate of First Class, Machilipatnam. Heard the learned counsel for both parties.

The learned counsel for the petitioner seeks permission of this Court to permit the petitioner to withdraw the criminal revision case with liberty to avail the remedies available to her under law. He further submitted that the presence of the petitioner before the trial Court may be dispensed with.

Permission is granted.

The petitioner is none other than the mother-in-law of the second respondent. There is no dispute with regard to the identity of the petitioner. Even if her presence is dispensed with, no prejudice will be caused to the second respondent. Hence, the Criminal Revision Case is dismissed as withdrawn granting liberty as prayed for. The presence of the petitioner, who is accused No.2 in C.C.No.328 of 2011, before the trial Court is hereby dispensed with on each and every date of adjournment. However, she shall appear before the trial Court as and when her presence is so required.

Consequently, Miscellaneous Petitions, if any, pending in this Criminal Revision Case shall stand closed.
