THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.4434 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner who is arrayed as Accused No.1 in Crime No.51 of 2022 on the file of Sadashivanagar Police Station, Kamareddy District for the offence punishable under Sections 307, 323 and 506 read with Section 34 of Indian Penal Code. 2.

Heard learned counsel for the petitioner/Accused No.1 and the learned Public Prosecutor for the respondent-State. Perused the record.

It is the case of the prosecution that the petitioner and others attacked the injured persons out of previous enmity on 02.04.2022, when an altercation took place between the petitioner, A2, A3 and others. In the said process it is alleged that the petitioner/Accused No.1 caused injuries to three persons with a knife.

Learned counsel for the petitioner submits that the injured persons were discharged from the hospital on treatment. He further submits that Accused Nos.2 and 4 were granted bail by this Court on 05.05.2022. The petitioner is in jail since 04.04.2022. Therefore, prayed to grant bail to the petitioner/Accused No.1. 5.

As seen from the remand report, nine witnesses including three victims were already examined, further, seizures were also effected. In view of the above, this Court is inclined to grant bail to this petitioner/Accused No.1.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused No.1 is granted bail subject to the following conditions:

i) The petitioner/Accused No.1 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of Judicial First Class Magistrate at Kamareddy.

ii) The petitioner/Accused No.1 shall appear before the concerned Station House Officer on every Saturday between 10.30

AM and 01.00 PM for a period of three (03) months or until filing of charge sheet, whichever is earlier.

iii) The petitioner/Accused No.1 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. Miscellaneous applications, pending if any, shall stand closed. _____________ K.SURENDER, J Date: 07.06.2022 ns
