THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM Writ Petition No 31527 of 2017 ORDER:

This Writ Petition is filed alleging that respondent No.7 is making construction in the road passage, which is adjacent to the petitioner's house.

Respondent No.6-The Gram Panchayat Amistapur filed counter affidavit specifically stating that respondent No.7 is not making construction on any road and he is only renovating his old existing house. However, it is stated that as respondent No.7 has not obtained permission from the Gram Panchayat for renovating the existing house, notice has been issued to respondent No.7 on 19.08.2017 and necessary action would be taken after considering the explanation that may be submitted by respondent No.7.

Heard the learned counsel for petitioner, learned Government Pleader for Panchayatraj & Rural Development (TG) for the respondents 1 to 3, learned Government Pleader for Home (TG) for respondent No.4, and Sri G.Narender Reddy, Standing counsel appearing for the respondents 5 & 6. 4.

In the facts and circumstances of the case, the allegation of petitioner that respondent No.7 was occupying the road being disputed, this Writ Petition is disposed of, by

CKR, J W.P.No.31527 of 2017 leaving it open to the petitioner to work out remedies, to assert his right, if any, with respect to the passage, in the Civil Court. It is further observed that respondent No.6 may take necessary action pursuant to the notice issued to respondent No.7. The disposal of this writ petition shall not be construed expressing any opinion with respect to the notice issued by respondent No.6 to respondent No.7. No order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
