HONOURABLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION Nos.3523, 3524, 3525 and 3537 OF 2017 COMMON ORDER:
The petitioner - Munisekhar - has moved all these four Criminal Petitions requesting for grant of anticipatory bail under Section 438 of the Criminal Procedure Code, 1973 (for short, 'the Code').

In Criminal Petition No.3523 of 2017, the petitioner is figuring as accused No.2 in O.R. No.1 of 2017 of S.V.N.P. Chamala Range, Bakarapet of Chittoor District. In Criminal Petition No.3524 of 2017, the petitioner is figuring as accused No.18 in Crime No.9 of 2017 of Rompicherla Police Station. In Criminal Petition No.3525 of 2017, the petitioner is figuring as accused No.18 in Crime No.7 of 2017 of Yerravaripalem Police Station. In Criminal Petition No.3537 of 2017, the petitioner is figuring as accused No.1, along with accused No.2 - Syed Mahamood Rafi, who is co-petitioner, in O.R. No.128/2016-2017 of S.V.N.P. Chamala Range, Bakarapet of Chittoor District.

The offences alleged to have been committed by the petitioner are punishable under Sections 20 (1) C (ii) (iii) (iv) (ix) & (x) and clause (d) under Sections 29, 32 (A) (B) (C) and Section 62 (A) (1) (2) & (3) of A.P. Forest (Amendment) Act, 2016 (A.P. Act No.15 of 2016) and in contravention to under Sections 27 & 29 of Wild Life Protection Act, 1972.

Heard Sri P.V. Vidyasagar, the learned counsel for the petitioners in all these petitions, and the learned Assistant Public Prosecutor for the State of Andhra Pradesh.

The learned counsel for the petitioner would submit that all other accused persons in the aforesaid crimes were enlarged on bail, having been arrested. It is also his submission that a direction be given to the petitioners to surrender before the Court concerned and to make an appropriate petition, and also to direct the learned Magistrate to dispose of the petitions on the very same day. 6.
His submission appears to be reasonable, and, therefore, while dismissing all these Criminal Petitions, petitioner - Munisekhar in Criminal Petition Nos.3523, 3524 and 3525 of 2017 and the petitioners 1 & 2, Munisekhar (A1) and Syed Mahamood Rafi (A2), in Criminal Petition No.3537 of 2017 are directed to surrender before the Judicial Magistrate of First Class, Pileru, and they are at liberty to move the relevant applications, and in case the same is done, the learned Magistrate is directed to dispose of the petitions on the same day in accordance with law on their own merits. As a sequel thereto, Miscellaneous Petitions, if any, pending in the Criminal Petitions shall stand closed.
