THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.8181 of 2016 ORDER:

This Criminal Petition is filed by the petitioners/A-2 to A-5 under Section 438 Cr.P.C., seeking anticipatory bail in Crime No.149 of 2016, on the file of Hanamkonda Police Station, Warangal District, registered for the offences punishable under Sections 417, 420, 376(2) (n) & 506 IPC and Sections 3(1)(w) & 3(2)(v), 3(2)(v)(a) of SCs & STs (POA) Act, 1989 and SCs & STs (POA) Amendment Act, 2015. Heard and perused the material available on record. The allegations against the petitioners are that A-1 got introduced to the de facto complainant who is a private musical teacher seven years back when she was proceeding to St. Peter's School, which converted into friendship and they became lovers and A-1 took Rs.4.

5 lakhs of cash, 15 grams of gold and i-phone from the de facto complainant by saying deceitful words that he will marry her and later A-1 took the de facto complainant to rented room of his friend and committed rape by giving her drugs and also took her nude photographs with his cell phone and A-1 had sexual intercourse with her many times by showing her nude photographs since two years. A1 used to maintain distance with the de facto complainant when she forced him to marry her and about 20 days back, when the de facto complainant went the house of A-1, A-1 and his family members insulted and abused her in the name of caste and threatened her with dire consequences.

The learned Additional Public Prosecutor opposed this petition and submitted that in view of the nature of the offence, this petition for anticipatory bail is not maintainable.

Considering the facts and circumstances of the case and the submissions made by the learned Additional Public Prosecutor and in view of the nature of the offence, this Court is of the view that this petition is not maintainable.
