HONOURABLE SMT JUSTICE P.MADHAVI DEVI W.P.No.23726 OF 2022 ORDER:

This writ petition is filed seeking a direction to the respondents not to construct a new nala in the residential area of East Kakatiya Nagar to Banda Cheruvu.

The grievance of the petitioners is that the respondents have conducted a survey to construct a new nala in spite of there being existing nala and that is causing severe inconvenience to the residents of the colony. Sri Chatla Madhu, learned Stanidng Counsel for respondents 2 to 5, on instructions, submits that there is no proposal to make any new nala in the residential area of East Kakatiya Nagar and if any steps are going to be taken for construction of a new nala, notices would be given to the residents of the colony.

Considering the said submissions, this Court is of the opinion that there is no immediate cause of action to the petitioners to apprehend that fresh nala is going to be constructed.

Therefore, the Writ Petition is dismissed. However, the respondents are directed to issue notice to the parties in case they intend to construct new nala.
