Heard learned counsel for petitioner/A5 and the learned Public Prosecutor appearing for the State.
The petitioner is A5 in crime No.19 of 2018 of Kodavalur Police Station, SPSR Nellore District, registered on 15.02.2018 for the offences punishable under Sections 452, 324, 307 r/w 34 IPC.
No doubt as pointed out by the learned counsel for the petitioner from the very FIR allegations on that day at about 12.45 Noon, Kareemulla, Mastan, Amar, Naveen, Vamsi (petitioner/A5), Srikanth and Nagaraju armed with sticks and iron rods entered into their house and Mastan bet with iron rod on the head of the defacto complainant Areti Venkamma wife of Thirupathi and others bet with sticks, hands and legs her son Srinivas and also with sticks or hands or legs her sister Alivelu and she sustained bleeding head injuries and her son also sustained some injuries and her sister also sustained contusive injury to her left elbow and the accused fled away and that there is no specific overt act attributed against the petitioner, but for one of the members of the so called unlawful assembly and there is no case under Section 307 IPC for not even a case of Mastan has given several blows on her but for the one and all fled away.
However, still it is not a fit case for grant of anticipatory bail including from the say of the petitioner is a national player in Ragbi.
Hence, this Criminal Petition is disposed of rather dismissal by giving liberty if chosen to file regular bail by surrender before the learned Sessions Judge concerned and file proof of the surrender by affidavit and with notice to Public Prosecutor concerned for grant of regular bail if not on the same day, at least by next day with necessary conditions including for surrender of passport, furnishing of bank account if any and participation of investigation etc. Miscellaneous petitions, if any, shall stand closed. _______________________________ Dr. B.
